It has long played an important role in human societies. The rules of inheritance differ between societies and have changed over time. TerminologyIn common law jurisdictions, an heir is a person who is entitled to receive a share of the decedent's property, via the rules of inheritance in the jurisdiction where the decedent died or owned property at the time of death. Strictly speaking, one becomes an heir only upon the death of the decedent. It is improper to speak of the "heir" of a living person, since the exact identity of the persons entitled to inherit are not determined until the time of death. In a case where an individual has such a position that only her/his own death before that of the decedent would prevent the individual from becoming an heir, the individual is called an heir apparent. There is a further concept of jointly inheriting, pending renunciation by all but one, which is called coparceny. In modern legal use, the terms inheritance and heir refer only to succession of property from a decedent who has died intestate (that is, without a will). It is a common mistake to refer to the recipients of property through a will as heirs when they are properly called beneficiaries, devisees, or legatees. From Wikipedia under the
GNU Free Documentation License When do you have to pay inheritance tax ? Q. My uncle let me some money that was in a cd. It was POD (pay on death) will I have to pay inheritance tax on POD inheritance? Asked by tomwilla - Thu Jun 12 22:31:04 2008 - - 4 Answers - 1 Comments A. There are no Federal inheritance taxes. Do NOT report the inheritance on your Federal tax return. Any interest that the CD earns AFTER his death is taxable income to you but the principal amount is not taxable. If there are any Estate taxes, those would be paid by the estate. However if the CD was held in a tax-deferred account such as an IRA, then it would be taxed as ordinary income when you withdrew the funds since the money would have gone in tax-free. A few states do still have inheritance taxes. PA, NJ and LA immediately come to mind although there may be others. His state of residence at the time of his death and your state of residence will determine if any State inheritance tax is due. I recently was left an inheritance from my grandmother and don't know if I should use it all to pay off my student loans. There is enough to cover it an have a small amount left over. Asked by Benny - Thu Mar 5 19:48:09 2009 - - 6 Answers - 0 Comments A. Use the money to get yourself out of debt so that you have a good start in life. At this time, most investments are down so by paying off your loans, you have "made" whatever interest you are no longer paying.
